Leader of YABLOKO faction in the Legislative Assembly of St.Petersburg Grigory Yavlinsky proposed to cut the propensity for corruption of the Law on the Federal Contract System. Yavlinsky introduced the draft into the Legislative Assembly.

One of the provisions of the law on the Federal Contract System establishes the right of the client to take the decision on unilateral non-performance of a contract according to the civil legislation. “Such an approach gives the client a very broad option to unilaterally terminate the contract, an operational and service contract in the first place”, said Grigory Yavlinsky. This way, according to the Civil Code of the Russian Federation, the client can cancel the contract at the moment of its performance and pay the contractor only part of the set price in proportion to the work that has been done.

Grigory Yavlinsky proposed to establish an exhaustive list of objective grounds for a unilateral repudiation of a contract. A special examination should be conducted in case the grounds for the dissolution of a contract can’t be defined by means of formal criteria.

Moreover, a contractor should have the right to appeal against the decision on the dissolution of a contract on an out-of-court basis. The Federal Anti-Monopoly Service may suspend the dissolution of the contract during the investigation of a complaint and allow the contractor to continue the performance of a contract.

According to Grigory Yavlinsky, his proposals will cut the propensity for corruption of the Law on the Federal Contract System and will give different companies the access to the governmental and municipal purchase market.
